Selling an apartment in Lucan works much like selling a house, but with extra paperwork from the Owners’ Management Company (OMC). Before closing, you must clear all service charge arrears and provide a management pack to the buyer’s solicitor. That pack covers the sinking fund, block insurance, accounts and any planned levies. Preparing it early avoids costly delays.
Selling an apartment in Lucan brings one extra party into the sale: the management company. Its records, accounts and insurance all become part of the buyer’s due diligence. As a result, a well-run OMC can speed up your sale, while a disorganised one can stall it for weeks.
Lucan has a large and growing stock of apartments and duplexes. Many sit in Adamstown, Finnstown and Griffeen, and around Lucan village and Liffey Valley. Buyers here are often first-time buyers, downsizers and investors, and each group asks slightly different questions.
This guide explains how service charges and the OMC work, what the buyer’s solicitor will request, and how to answer buyer questions with confidence.
An Owners’ Management Company is a company that owns and manages the common areas of an apartment development. In other words, it looks after everything outside your front door. That includes hallways, lifts, roofs, car parks, bin stores and landscaping.
Every apartment owner is a member of the OMC. Under the Multi-Unit Developments Act 2011 (the “MUD Act”), the developer must transfer the common areas to the OMC. Owners then elect directors, usually volunteer residents, to run the company.
Most OMCs hire a managing agent to handle day-to-day work. The agent collects service charges, arranges insurance, organises repairs and keeps the accounts.
However, the OMC remains legally responsible for the development. The agent simply acts on its behalf. Managing agents in Ireland need a licence from the Property Services Regulatory Authority (PSRA).
When you sell, the managing agent usually prepares the documents your buyer needs. So contact them as soon as you decide to sell.
The annual service charge is your share of the cost of running the development. The OMC sets a budget each year, and members approve it at the AGM. Your share then depends on the size or type of your unit, as the development’s rules set out.
Charges vary widely between developments. For instance, a block with lifts, underground parking and a concierge will cost far more than a small duplex scheme. Therefore, always quote your own development’s current figure rather than a local average.
A sinking fund is a reserve that the OMC builds up for major future works. Typical examples include roof repairs, lift replacement, window replacement and external painting.
Under the MUD Act, the OMC must set up a sinking fund. The Act sets a minimum annual contribution of €200 per unit, unless members vote otherwise at a general meeting. Buyers increasingly ask about the fund’s balance, because a healthy fund lowers the risk of a surprise levy.
You must pay all service charges up to the closing date. In practice, the buyer’s solicitor will ask for written confirmation from the managing agent that your account is clear.
Solicitors usually apportion the current year’s service charge on closing. For example, if you have prepaid the full year, the buyer may refund the portion after the closing date. Your solicitor will confirm how this works for your sale.
The condition of the management company affects buyer confidence almost as much as the apartment itself. The table below shows how each side typically plays out during a sale.
How the OMC Affects Your Sale
| Factor | Well-Run OMC | Poorly Run OMC |
|---|---|---|
| Management pack | Agent issues it within days | Documents go missing or arrive late |
| Service charge accounts | Audited, filed and up to date | Late filings or unclear arrears |
| Sinking fund | Healthy balance and a clear works plan | Low or empty fund, so levy risk rises |
| Block insurance | Current policy with a clear schedule | Gaps, high excess or rising premiums |
| Buyer confidence | Buyers bid with certainty | Buyers hesitate or reduce offers |
| Mortgage lender | Valuer has few concerns | Lender may ask extra questions |
| Time to close | Usually on schedule | Weeks of delay are common |
If your OMC falls into the second column, don’t panic. Instead, raise it with your agent and solicitor early, so you can plan answers before a buyer asks.
Once you go sale agreed, the buyer’s solicitor raises pre-contract enquiries and requisitions. For apartments, many of these relate to the OMC. The Law Society’s standard requisitions include a section on multi-unit developments.
Managing agents often charge a fee for preparing the pack. Requesting it before you list means your solicitor can issue contracts faster once you agree a price.
Buyers at viewings and their solicitors tend to ask the same questions. Having clear answers ready builds trust and, consequently, protects your price.
Answer each question honestly and in writing where possible. In addition, keep a copy of the latest AGM minutes to hand, because buyers and solicitors often ask for them.
Some apartment developments built in Ireland between 1991 and 2013 have fire safety, structural or water ingress defects. Buyers know this, so they will ask about it.
The Government currently funds an Interim Remediation Scheme for fire safety defects, which the Housing Agency administers. In addition, the Apartment and Duplex Defects Remediation Bill is progressing through the legislative process.
A known defect does not make an apartment unsellable. That said, clear information and a realistic price are essential.

Yes. You must clear all service charge arrears before the sale closes. In practice, the buyer’s solicitor will ask the managing agent to confirm you have paid your account in full. If you have arrears, your solicitor can often pay them from the sale proceeds on closing. However, it is better to settle them early to avoid delays.
A management pack is a bundle of documents from your Owners’ Management Company or managing agent. It typically includes service charge confirmation, the budget, audited accounts, sinking fund details, block insurance and house rules. As a result, the buyer’s solicitor can check the development is well run before the buyer signs contracts.
It depends on when the OMC raised the levy and what buyer and seller agree. Generally, a levy already due before closing falls to the seller. Meanwhile, a levy raised after closing usually falls to the buyer. For agreed but unpaid levies, your solicitor will negotiate the position in the contract, so disclose any levy early.
They can, because buyers factor running costs into what they can afford. That said, buyers will usually accept a higher charge when it pays for real value, such as lifts, secure parking or a healthy sinking fund.
